Welcome to Luxury Homes Showcase. These Terms of Service ("Terms") govern your access to and use of the website (luxuryhomesshowcase.com) and the automated luxury real estate marketing platform and services (collectively, the "Services") provided by Luxury Homes Showcase ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Description of Services

Luxury Homes Showcase provides an automated, "zero-effort" marketing platform designed for elite solo real estate producers. Our proprietary technology extracts listing data to automatically generate premium 2 and 4-page digital magazine spreads, execute hyper-targeted digital campaigns, and distribute physical 8.5x11 EDDM (Every Door Direct Mail) mailers. The specific deliverables, distribution reach, and features available to you depend on your selected quarterly growth tier.

2. Subscriptions and Billing

Our Services are offered on a flat-rate quarterly subscription basis. By selecting a growth tier (Starter, Authority, or Sovereign), you agree to the following terms:

  • Billing Cycle: You will be billed on a quarterly basis. Your subscription will automatically renew at the end of each quarter unless cancelled prior to the renewal date.
  • Payment: You must provide accurate and complete billing information. Payments are managed through our Priority Bookshelf App Dashboard Billing system or other designated third-party payment processors.
  • Tier Upgrades/Downgrades: You may change your subscription tier. Changes will take effect at the start of your next quarterly billing cycle.
  • Refunds: Due to the automated, institutional-grade production costs and immediate deployment of assets, subscription fees are generally non-refundable except as required by law.

3. User Content and Data Extraction Permissions

To provide our "zero-effort" production model, our platform continuously monitors active luxury inventory across target markets. By using our Services, you agree to the following:

  • Data Access: You grant us permission to automatically extract, format, and utilize your active property listing data, including architectural descriptions and photography, from relevant property databases and MLS feeds.
  • Content Ownership and Rights: You represent and warrant that you own or have the necessary licenses, rights, and permissions to use and authorize us to use all property photography, copy, and data associated with your listings.
  • Accuracy: While we utilize proprietary property databases to pull data, you are ultimately responsible for the accuracy of your listing information. We are not liable for any misrepresentations or errors present in the original listing data source.

4. Intellectual Property

While you retain all ownership rights to your original property data and photographs, Luxury Homes Showcase retains all right, title, and interest in and to the platform, including:

  • Proprietary software, automation technology, and the Priority Bookshelf App.
  • Editorial layouts, typography styling, magazine templates, and finalized composited marketing assets.

You are granted a limited, non-exclusive, non-transferable license to use the finalized marketing assets created for your specific listings solely for the purpose of marketing those properties during your active subscription.

5. User Conduct

You agree not to use the Services to:

  • Market properties you do not have a legal right or valid agreement to represent.
  • Violate any local, state, national, or international law or regulation, including Fair Housing laws and real estate advertising compliance rules.
  • Interfere with or disrupt the integrity or performance of our platform or proprietary technology.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Luxury Homes Showcase and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Services.
  • The success, failure, or specific outcome of any real estate transaction, as we do not guarantee the sale of any property or a specific return on investment from our marketing campaigns.
  • Any errors or omissions in the marketing materials resulting from inaccurate source data.

7. Termination and Cancellation

You may cancel your quarterly subscription at any time by contacting your dedicated account manager or through the dashboard. Cancellation will stop the subsequent quarterly renewal. We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Collin County, Texas.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
